Comfy Pets (“Company”, “We”, “Us”, or “Our”) operates the website available at www.comfypets.in (collectively hereinafter referred to as the “Platform”). Our registered office is located at Lakshmi Veda Arch, 3B, 8-2-293/82/A/1217, Road No. 36, Jubilee Hills, Hyderabad, Telangana 500033.

These Terms of Service (“Terms”) govern Your access to or use of the Platform and the Services (as defined below) made available on the Platform. By accessing the Platform or using the Service, You agree to these Terms. Your access to or use of the Service is conditioned on Your acceptance of and compliance with these Terms and other policies of the Platform.

 

Please read these Terms and all other policies of the Platform (“Platform Policies”) carefully before using or registering on the Platform. If You do not agree with these Terms, please do not access the Platform or use the Service.

1. Marketing Communications

Unless you notify us in writing of your intention to opt out from marketing communications, you agree to continue to receive emails, calls, and messages through different mediums for the purpose of soliciting and informing you about our Products.

2. The Services

The Company provides the service of:

  • (i) Offering for sale various pet care products including food, medicines, toys, and accessories for pets on the Platform (“Product(s)”).

  • (ii) Facilitating access to pet-related information and commerce (collectively the “Services”).

These Terms: (i) will be considered to be an electronic record under the Indian data privacy laws including the Information Technology Act, 2000; and (ii) will not require any physical, electronic, or digital signature by the Company.

 

3. Eligibility and Access

The Service is not available to persons under the age of 18 (eighteen) years or to any User suspended or removed from the Platform for any reason whatsoever. You represent that You are of legal age to form a binding contract and are not barred from receiving Services under the applicable laws of India.

 

4. Access and Use of Service

  • Account Creation: To use certain Services, You must create an account (“Account”) by providing details such as Your name and email address.

  • Accuracy: You ensure that the Account information provided is accurate and up-to-date. Providing untrue or incomplete information gives the Company the right to suspend or terminate Your Account.

  • Confidentiality: You are responsible for maintaining the confidentiality of Your Account credentials. You agree to notify the Company immediately of any unauthorized access.

  • Prohibitions: You shall not have more than one active Account. Selling, trading, or transferring Your Account is strictly prohibited.

5. Sale of Products and Medicines

  • Invitation to Offer: The listing of Products on the Platform is an ‘invitation to offer’ and not an ‘offer for sale’. We reserve the right to accept or decline any order in Our sole discretion.

  • Prescription Medicines: Comfy Pets abides by all applicable laws relating to the dispensing of prescription medicines. If You order prescription medicines, You must share a valid scanned copy of the prescription. All such orders are subject to the scrutiny and approval of our registered pharmacist.

  • Substitutions: Substitution of a brand for another of the same medical salt is permitted only where the prescription allows or where the composition and strength are an exact match, following verification by our pharmacist.

  • Product Information: Information provided on the Platform is for informative purposes only and is not intended as medical advice or diagnosis.

6. Acceptable Use

You represent and warrant that You shall not upload, share, or transmit information that:

  • Belongs to another person without right.

  • Is harmful, abusive, defamatory, obscene, or invasive of another’s privacy.

  • Infringes upon any intellectual property rights.

  • Contains software viruses or files intended to disrupt computer functionality.

  • Threatens the unity, integrity, or security of India.

7. Fees and Payment

  • Fees: Prices for Products and Services are as specified on the Platform.

  • Currency: All transactions are in Indian Rupees (INR).

  • Payment Security: Payments are processed through third-party providers. You represent that You are authorized to use the chosen payment method. The Company is not liable for unauthorized transactions conducted using Your payment details.

  • Shipping: Additional shipping charges may apply based on our Shipping Policy.

8. Ownership and Intellectual Property

The Company owns all right, title, and interest in and to the Platform, its “look and feel,” software, data, and trademarks (“Marks”). You shall not copy, duplicate, or reuse any portion of the Content or Marks without express written consent.

9. Privacy

Your privacy is important to us. Please refer to our Privacy Policy available at www.comfypets.in/pages/privacy-policy to understand how we collect and handle your personal data.

10. Disclaimers and Limitation of Liability

  • As-Is Basis: The Platform is provided on an “as is” and “as available” basis. We disclaim all warranties, express or implied.

  • Liability Cap: To the maximum extent permitted by law, the Company’s total cumulative liability to You for any cause of action will be limited to the amount paid by You for the specific purchase giving rise to the claim.

  • No Medical Guarantee: We do not warrant the effectiveness or safety of Products beyond the manufacturer's warranty. Reliance on Platform information is at Your own risk.

11. Indemnification

You agree to indemnify and hold harmless the Company, its directors, and employees from any claims, losses, or damages arising out of Your breach of these Terms or Your use of the Platform.

12. Suspension and Termination

The Company may block Your access or terminate Your Account at its sole discretion if it believes You have violated these Terms. You may cancel Your Account at any time by contacting info.comfypets@gmail.com.

13. Choice of Law and Jurisdiction

These Terms will be governed by and construed in accordance with the laws of India. Any disputes arising shall be subject to the exclusive jurisdiction of the courts at Hyderabad, India.

14. Delivery Policy

  • Logistics Partners: We use third-party providers for delivery. Timelines provided are tentative.

  • Unserviceable Areas: We reserve the right to determine unserviceable areas based on logistics or unforeseen circumstances (Force Majeure).

  • Risk of Loss: The title and risk of all Products pass to You upon delivery by the Logistics Partner.

15. Grievance Redressal

Any complaints arising from the usage of the Platform may be addressed to:

The Grievance Officer shall acknowledge the complaint within 48 hours and dispose of it within 30 days of receipt.

16. Communications

By using the Website and/or registering yourself at comfypets.com you authorize us to contact you via email or phone call or SMS or WhatsApp to offer you our services, imparting product knowledge, and offer promotional offers. Even if you have registered under DND or DNC or NCPR service, you still authorize us to give you a call from Comfy Pets for the above-mentioned purposes.
